This fits the bill, it's gathering information without consent and sending it to another entity. Most of what I'm sure you'd consider real spyware is collecting statistical information for "legitimate" market research companies, not sniffing for credit card numbers. At least the have the decency to use dark UI patterns or long EULA's to get consent.
