I would be interested to hear an expert opinion about whether such arrangement falls under 'unfair contract terms' descibed by the Office of Fair Trading: https://assets.publishing.service.gov.uk/government/uploads/...

Not sure if such regulation exists in the US, if so it would be worth to probe into it.
