There are many states where Bottle Rockets are still legal; they are generally states that are not considered a Nanny state or do not have high risk of fires. Some states like Texas banned them because too many houses had wooden shingled roofs decades ago that tended to catch fire because of a bottle rocket landing on them. A lot of places(From the state level down to individual city level) use the annual Consumer Product Safety Commission report on Firework injuries to determine what needs to be banned for so called "public safety" reasons. Which is why you have places that have even banned Sparklers.
