It sounds like with the surprise ruling to force service provision to wpe, and this response, there's little desire to be the free provider of dev infrastructure on the part of wp any more. Which is understandable if you're being compelled to do it.

AIUI the compulsion is just to leave things as they were while the case proceeds, I hope the judge has better criteria for understanding the situation than brought out at the summary judgement.
