This is ridiculous. We don’t send surgeons to jail if they mistakenly kill their patient.

We can and do if they are shown to be negligent or irresponsible, and at the very least are responsible for damages, hence medical malpractice insurance to ensure people get paid even if the surgeon is bankrupt.
