Exactly. This request specifically asks for protection under 2705(b) which grants a limited gag for up to 90 days if the publication of the warrant execution could lead to destruction of evidence or flight from prosecution. The power granted under 2705(b) last only 90 days and must be reauthorized if it is to be extended.

The scary thing about an NSL is that there is no automatic time limit to the gag order it creates, and due process to request the gag to be lifted is severely limited. In other words, not only don't we know about the NSLs issued, we don't even know when we might get a chance to know about them which makes any oversight of their use practically impossible.

Wow, I never knew that, small world. I have very fond memories of Coherent. I split the license cost (a whopping $99 bucks) with a buddy, both of us making near-minimum wage as bench techs for a used computer shop in Atlanta (which, much to my shock is still in business today). A few months later I scraped together enough money to pick up a used Sun 3/60 running Sun OS (and shortly after that, moved to an early version of Slackware), but Coherent will always be my first Unix.

I was just about to make the same argument. I completely see why this is tempting, but it quickly makes maintenance into a new layer of hell, and anyone supporting your production environment will hate you. Added to which, knowledge transfer becomes a huge problem, and it takes new developers and production support people a small lifetime to learn all the pieces and their touchpoints.

That's still an incredibly lame excuse. Someone took the time to write that language into the contract, and whether through malice or inaction, no one corrected it. It's unforgivable no matter who you point fingers at internally.
